The High Court of Malawi- Zomba District Registry has granted Mangochi South West legislator, Hon. Shadreck Namalomba judicial review and an interim stay of decisions against Leader of Opposition in Parliament, Hon. Dr. Kondwani Nankhumwa’s shadow cabinet.
Dr. Nankhumwa appointed his strong 32 member shadow cabinet which did not live long as it was faced by mass resignations of its members such as Hon. Hon. Joseph Mwanamvekha, Hon. Bright Msaka sc, Hon. Symon Vuwa Kaunda and Hon. Jappie Mhango case in point be the party’s leadership, former President and DPP leader, Prof. Arthur Peter Mutharika, not consulted.
As this was enough, Dr. Nankhumwa proved superiority over the DPP and its leadership to appoint Parliamentary Spokespersons in Parliament replacing those the Party recognizes as its true members and spokespersons.
Confusions, and misunderstandings in the mighty DPP have forced Namalomba who doubled as DPP and Presidential Spokesperson to go to court to seek an injunction stopping Nankhumwa from making decisions of the Party until the matter is resolved in court.
In the injunction obtained, Nankhumwa has been restrained from discharging the duties of the office of Leader of Opposition without consultation with and written approval from the Party’s leadership, appointing Shadow cabinet and Parliamentary Spokespersons.
The order has again put a big stone on Nankhumwa’s head that decisions made should not be recognized in the absence of proof in writing to the satisfactory of the Party and leadership consulted.
“Any party affected by or interested in this matter has the unqualified liberty to apply to the court to vary or discharge or set set-aside or vacate this order by giving 48 hours to the Claimant, Namalomba,” reads part of the court order.
Meanwhile, social media commentators have expressed doubts over the existence of the mighty DPP as all signs are indicating that the party is heading to its natural death as evidenced with battles for supremacy since the party was ousted from government on the 23rd June, 2020.
The commentators have borrowed former President Dr. Bakili Muluzi’s words that some of the party’s will die like curtains saying he made a prediction of the UDF and now the same fire is in the DPP blue camp to end like curtains on the wall
